These order terms ("Order Terms") apply to any order you place through www.tempestlondon.co.uk (the "Website"). These Order Terms apply regardless of how you access the Website. You must read these Order Terms carefully; by placing an order, you confirm that you have read, understood, and agree to them in their entirety.
1. ACCEPTANCE OF YOUR ORDER
1.1 Completion of the online checkout process does not constitute our acceptance of your offer to purchase. Our acceptance of your order takes place only when we dispatch the product(s) or commence the services.
1.2 Prior to dispatch, Tempest London reserves the right to decline an order for any reason, including legal or regulatory reasons.
1.3 We will notify you by email to acknowledge receipt of your order. If we cannot supply the product, we will inform you in writing and refund you in full. If fulfilment is illegal (e.g., breach of export controls), we reserve the right to cease the order at any time without liability, provided a full refund is issued for any sums paid.
2. PAYMENT
2.1 Tempest London uses Stripe Payments to process transactions. Your use of Stripe Payments is subject to their specific terms of service.
2.2 All products remain the property of Tempest London until we have received payment in full and the products have been delivered to your specified address.
3. DELIVERY AND RISK
3.1 Delivery is provided at no additional cost to UK addresses.
3.2 All risk in the products (including risk of loss or damage) passes to you when the products are delivered into your physical possession or the possession of a person identified by you to take delivery.
3.3 We are not liable for any delay or failure to deliver products if the delay is caused by circumstances beyond our reasonable control.
4. INTERNATIONAL DELIVERY
4.1 Products to be shipped to locations outside the UK will need to be agreed on a case by case basis. Use the Contact form to enquire about international shipping.
5. CANCELLATION AND RETURNS (COOLING-OFF RIGHTS)
If you are a consumer, you have a statutory right to cancel your contract under the Consumer Contracts Regulations 2013.
5.1 Cancellation Period: You may cancel all or part of your contract at any time up to 14 calendar days after the day on which you receive the goods.
5.2 How to Cancel: You must inform us of your decision to cancel by a clear statement (e.g., email or letter).
5.3 Returns & Costs: You are responsible for the direct cost of returning the goods to:

5.4 Condition & Refunds: You may examine the goods as you would in a shop. However, if the value of the goods is diminished by any amount as a result of handling of the goods by you beyond what is necessary to establish their nature, characteristics and functioning, we may recover that amount from you, up to the contract price.
5.5 Refund Timing: We will process your refund within 14 days of receiving the goods back, or 14 days after you provide evidence of having returned them.
6. FAULTY OR MISDESCRIBED GOODS
Under the Consumer Rights Act 2015, goods must be as described, fit for purpose, and of satisfactory quality.
6.1 The 30-Day Right: If your goods are faulty or misdescribed, you have a right to a full refund if requested within 30 days of delivery.
6.2 Repair or Replacement: After 30 days, we will typically offer a repair or replacement. If this is not possible or unsuccessful, you may be entitled to a price reduction or a full refund.
6.3 Return of Faulty Goods: We will cover the reasonable cost of return postage for faulty or incorrectly supplied items.

7. WEBSITE DESCRIPTIONS AND ERRORS
7.1 We take reasonable care to ensure prices and descriptions are accurate. However, orders are only accepted if there are no material errors in the description or price.
7.2 The weights, dimensions, and capacities shown are approximate. Colors may vary slightly depending on your monitor settings.
7.3 All items are subject to availability. If an item is unavailable, we will inform you as soon as possible.
8. LIMITATION OF LIABILITY
8.1 No Exclusion: Nothing in these Order Terms shall limit or exclude our liability for:
(a) death or personal injury caused by our negligence;
(b) fraud or fraudulent misrepresentation;
(c) any breach of your statutory rights under the Consumer Rights Act 2015; or
(d) any other liability which cannot be limited or excluded by law.
8.2 Foreseeable Loss: Subject to section 8.1, we are only responsible for loss or damage you suffer that is a foreseeable result of our breach of these terms.
8.3 Business Losses: We only supply products for domestic and private use. We shall have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
8.4 MONETARY LIMIT: Subject to section 8.1, our total liability to you in respect of all other losses arising under or in connection with any order—whether in contract, tort (including negligence), or breach of statutory duty—shall be limited to the total price paid by you for the products and services in that specific order.
9. GENERAL
9.1 Changes: We may update these terms from time to time to comply with law or business requirements.
9.2 Governing Law: These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
